INTRODUCTION
These Terms of Service and End User Agreement (the "Terms") apply when you use "My Gamer Life" (the "Game") owned and operated by GAMURS Pty Ltd and its related entities ("GAMURS", "we," "us," or "our"). Please review the Terms carefully before using the Game. By launching the game you agree to adhere to and be bound by these Terms . If you do not accept any part of these Terms, you may not use or access the Game.
THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND DISCLAIMERS OF LIABILITY.
1. AGE REQUIREMENTS AND CHANGES TO TERMS
1.1 Age Requirements
You must be 13 years or older to use the Game. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that your legal guardian has reviewed and agreed to these Terms.
1.2 Changes to Terms
GAMURS may change these Terms at any time at its sole discretion. Your continued use of the Game after any changes to the Terms will be deemed an acceptance of the changes. It is your responsibility to check these Terms periodically for changes.
1.3 Game Updates
GAMURS may from time to time, in its sole discretion, develop and provide Game updates, which may include upgrades, bug fixes, patches, other error corrections and/or new features (collectively, including related documentation, “Updates”). Updates may also modify or delete in their entirety certain features and functionality. You agree that GAMURS has no obligation to provide any Updates or to continue to provide or enable any particular features or functionality. Based on your device settings, when your device is connected to the internet either:
* The Game will automatically download and install all available Updates; or
* You may receive notice of or be prompted to download and install available Updates.
You shall promptly download and install all Updates and acknowledge and agree that the Game or the portions thereof may not properly operate should you fail to do so. You further agree that all Updates will be deemed part of the Game and be subject to all terms and conditions of the Terms and the Privacy Policy.
2. PRIVACY PRACTICES
For information about GAMURS' privacy practices with respect to the Game, please review our Privacy Policy at Privacy Policy. The Privacy Policy outlines what information GAMURS collects, how the data is collected, and how the information is used. By accessing or using the Game, you indicate that you understand and consent to the information collection, use, and disclosure practices described in the Privacy Policy. You further understand that you may be required to provide certain information about yourself as a condition to use certain features or functionality of the Game.
3. LICENSE TO USE THE GAME
3.1 Grant of License
Subject to your complete and ongoing compliance with these Terms, GAMURS grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to
* Download, install, and use the Game for your personal, non-commercial use on a single mobile device owned or otherwise controlled by you, strictly in accordance with these Terms and the Privacy Policy.
3.2 Restrictions on Use
You agree not to:
* Copy, modify, translate, adapt, distribute, sell, lease, or create derivative works based on the Game
* Reverse engineer, decompile, or attempt to extract the source code of the Game
* Remove, delete, alter of obscure and trademarks or any copyright, trademark, patent, or other intellectual property or proprietary rights notices from the Game, including any copy thereof
* Use the Game for any illegal purpose or in violation of any local, state, national, or international law
* Exploit the Game or any of its parts for any commercial purpose
* Use cheats, automation software, hacks, bots, mods, or any unauthorized third-party software designed to modify or interfere with the Game
* Use the Game in any manner that could damage, disable, overburden, or impair it
* Attempt to gain unauthorized access to the Game, other users' accounts, or GAMURS' computer systems or networks
4. USER ACCOUNTS
4.1 Account Creation
To access and use certain features of the Game, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4.2 Account Security
You are responsible for safeguarding the password that you use to access the Game and for any activities or actions under your password. You agree not to disclose your password to any third party. GAMURS is not responsible for the circumvention of any of your privacy settings or security measures. You are solely responsible for any activity that occurs in connection with your account, including any unauthorized use. You must notify GAMURS immediately upon becoming aware of any breach of security or unauthorized use of your account.
4.3 Account Termination
GAMURS reserves the right to terminate or suspend your access to the Game at any time, with or without cause, and with or without notice. Causes for account termination may include, but are not limited to:
* Violation of these Terms
* Engaging in fraudulent or illegal activities
* Creating multiple accounts
* Prolonged inactivity
* Engaging in conduct that is harmful to other users, third parties, or GAMURS
You may terminate these Terms by deleting the Game and all copies thereof from your device.
Upon termination:
* All rights granted to you under these Terms will also terminate
* You must cease all use of the Game and delete all copies of the Game from your device and account.
For the avoidance of doubt, termination will not limit Gamurs’ rights or remedies at law or in equity.
5. VIRTUAL CURRENCY AND ITEMS
5.1 Virtual Currency
The Game may include virtual currency such as "JoyStick Points" and "Money" (collectively, "Virtual Currency"). JoyStick Points can be earned by watching advertisements or purchasing them. Money can be earned through gameplay or purchased with real money. Virtual Currency is used for premium options in the Game.
5.2 Purchasing Virtual Currency
All purchases of Virtual Currency are final and non-refundable, except where required by applicable law. GAMURS reserves the right to change the pricing for Virtual Currency at any time.
5.3 Virtual Items
The Game may allow you to purchase or earn virtual items. Virtual items may be used exclusively within the Game. You acknowledge that GAMURS may modify, manage, or eliminate Virtual Currency and virtual items at any time and for any reason, with or without notice.
5.4 No Real-World Value
Virtual Currency and virtual items have no real-world value and cannot be exchanged for real money, goods, or services outside the Game. You acknowledge that you do not own the Virtual Currency or virtual items, but instead you possess a limited, non-transferable, revocable license to use such content within the Game only.
6. USER CONTENT
6.1 User Content
The Game may allow you to create, upload, or share content such as text, images, or other material ("User Content"). You retain all rights in your User Content, subject to the license you grant to GAMURS.
6.2 License to GAMURS
By submitting User Content to the Game, you grant GAMURS a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Game and GAMURS' business, including for promoting and redistributing part or all of the Game.
6.3 Content Restrictions
You agree that you will not post, upload, or transmit any User Content that:
* Infringes any third party's intellectual property or other rights
* Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
* Contains viruses, trojan horses, worms, time bombs, or other harmful computer code
* Promotes illegal activity or conduct that is invasive of another's privacy
* Impersonates any person or entity or falsely states or misrepresents your affiliation with a person or entity
7. INTELLECTUAL PROPERTY
7.1 Ownership
You acknowledge and agree that the Game is provided under a license, and has not been sold to you. The Game, including all content, features, and functionality thereof, is owned by GAMURS, its licensors, or other providers of such material and is protected by copyright, trademark, and other intellectual property laws.
7.2 Trademark Notice
"GAMURS," "My Gamer Life," and all related names, logos, product and service names, designs, and slogans are trademarks of GAMURS or its affiliates. You may not use such marks without the prior written permission of GAMURS.
7.3 Copyright Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact our designated copyright agent at [email protected] with the following information:
* Description of the copyrighted work that you claim has been infringed
* Description of where the material that you claim is infringing is located on the Game
* Your contact information
* A statement that you have a good faith belief that the disputed use is not authorized
* A statement, made under penalty of perjury, that the information in your notice is accurate
8. THIRD-PARTY LINKS AND SERVICES
The Game may contain links to third-party websites or services that are not owned or controlled by GAMURS, including through third-party advertising. GAMURS has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that GAMURS shall not be responsible or liable for any damage or loss caused by your use of any such third-party materials, websites, or services. Third-party materials, websites, or services and any links thereto are provided solely as a convenience to you, and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.
9. DISCLAIMERS OF WARRANTIES
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GAMURS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
GAMURS DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GAME IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAMURS, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
* YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE GAME
* ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE GAME
* ANY CONTENT OBTAINED FROM THE GAME
* UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
*PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, DEVICE FAILURE OR MALFUNCTION
IN NO EVENT SHALL GAMURS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE GAME EXCEED THE AMOUNT PAID BY YOU TO GAMURS FOR THE GAME, IF ANY, DURING THE 12 MONTHS PRIOR TO THE CLAIM.
THE FOREGOING LIMITATIONS WILL APPLY WHETHER SUCH DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR GAMURS WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless GAMURS, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Game, your violation of these Terms, or your violation of any rights of another.
12. GOVERNING LAW AND DISPUTE RESOLUTION
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be finally settled by arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration. The seat of arbitration shall be Sydney, Australia. The language of the arbitration shall be English. The prevailing party of a dispute arising out of or relating to these Terms shall be entitled to recover its reasonable attorneys’ fees and costs.
12.3 Exceptions
Notwithstanding the foregoing, GAMURS may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.
12.4 Limitation of Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE GAME MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES OTHERWISE SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
13. MISCELLANEOUS
13.1 Entire Agreement
These Terms constitute the entire agreement between you and GAMURS regarding your use of the Game, superseding any prior agreements between you and GAMURS relating to your use of the Game.
13.2 Waiver and Severability
The failure of GAMURS to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term, and the remaining provisions shall be enforced.
13.3 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without GAMURS' prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and of no effect. GAMURS may assign or transfer these Terms, at its sole discretion, without restriction.
13.4 Notice
GAMURS may provide you with notices, including those regarding changes to these Terms, by email, regular mail, or postings on the Game. Notice will be deemed given twenty-four hours after email is sent, unless GAMURS is notified that the email address is invalid, or seven days after mailing by registered or certified mail.
